Under the Federal Hazardous Substances Act, the Consumer Product Safety Commission has explicit authority to protect consumers from the health hazards caused by the use of non-polymeric, additive form, organohalogen flame retardants in children’s products, furniture, mattresses and the casings surrounding electronics. Warning consumers of hazards would not adequately protect consumers from the adverse health impacts.
